Committee upholds decision on professional conduct breach

The RTPI's appeal committee has upheld a decision of the conduct and discipline panel in respect of a planning consultant member found to be in breach of the professional code of conduct. The consultant member was commissioned at short notice to submit an appeal statement against an enforcement notice. In doing so, she failed to visit the site to check crucial facts prior to submitting the appeal statement, and instead, relied upon incorrect information supplied by the client as to the view from and internal dimensions of the neighbouring properties. She also referred to a previous adviser as an "Architect" when that person was not permitted to use the title "Architect". As a result the appeal statement was incorrect and misleading. The appeal committee confirmed that consultants have a responsibility to check information to ensure that it is correct and cannot simply rely upon information provided by others. The member was found to be in breach of Code (a), (c), and Byelaw 7(2) insofar as she failed to act with competence, thus bringing the profession into disrepute, and failed to discharge her duty to her client and members of the public with due care and diligence. As a result, the appeal committee agreed that the member should be reprimanded without being named in the published report.
